Consider the audience for your writing. Writing to a lay client will differ greatly from writing to another lawyer. When composing for an audience lacking legal expertise, strive for maximum clarity and reserve the usage of legal jargon for proper situations.
Avert vagueness and gray zones. When stating who is responsible for what, use the active voice. For example, “The seller shall deliver the goods” is preferable to “the goods shall be delivered.”
Certain terms in general and legal English have distinct meanings. For instance, “shall” denotes “must” in the sentence “The seller shall deliver the goods,” yet in everyday English, it’s used to suggest things like “Should we go to the pub?”
Words that have the same sound as another word but a distinct spelling and meaning are called homophones. Here are a few instances:

Contrary to discrete, which denotes maintaining something private, discrete indicates individually independent and different.
Previously or formally
Formerly denotes earlier or in the past, whereas formally denotes adhering to norm.

While insure refers to the insurance of something or someone, ensure refers to making sure that something occurs.
M any formal adverbs of reference, such as “herein,” which meaning “in this document,” are still often used in legal English. Other instances are “hereto” and “hereby.” Adverbs can be confusing for non-literate readers, but when used properly, they make it easier for readers to follow along with the text. Familiarize yourself with the formal adverbs used in legal documents, and resist the urge to substitute other terms for them.
